I respectfully urge you to join Senators Orin Hatch and Tom
Harkin as cosponsors of S-1330, the Dietary Supplement Tax
Fairness Act of 2001.
The bill would amend the Internal Revenue Code of 1986 to
provide that amounts paid for foods for special dietary use,
dietary supplements, or medical foods shall be treated as
medical expenses and should be covered by health insurance
plans; people should have the right to choose their healthcare
treatments.
In addition, these alternative health care products should
be tax deductible for employers and excluded from employee’s
taxable income.
The "Findings" of Congress set forth in the bill
state that:
"Such items have been shown through research and
historical use to be a valuable benefit to human health as
well as disease prevention. Children with birth defects,
metabolic disorders and autism, as well as all individuals
with diabetes, autoimmune disorders and chronic inflammatory
conditions (Hepatitis C), frequently require daily dietary
interventions in addition to medical interventions to manage
their conditions. However, without health insurance support,
such dietary interventions become a significant economic
burden on such individuals.

Please cosponsor H.R.2265, "The Foods
Are Not Drugs Act of 2001."
Foods should not be regulated as drugs.
A serious flaw in the Food, Drug & Cosmetic Act, is
that its definition of "drug" includes foods and
dietary supplements which are truthfully labeled with an
intent to prevent disease. This overly broad definition
states: Sec. 201 (g)(1): The term "drug" means
(B) articles intended for use in the diagnosis, cure,
mitigation, treatment or prevention of disease in man or
animals. "Articles" includes foods and
dietary supplements which should be exempted from the
definition of a "drug."
H.R.2265 will now add the 6 following words: "other
than foods including dietary supplements" to
exempt "foods and dietary supplements" from the
definition of a "drug." The definition of the term
"drug" will then read: Sec. 201 (g)(1): The term
"drug" means (B) articles, other than foods
including dietary supplements, intended for use
in the diagnosis, cure, mitigation, treatment or prevention of
disease in man or other animal.
5-HTP is extracted from the seed of an African herb known
as Griffonia Simplicifolia which is sold as a dietary
supplement. 5-HTP is NOT a drug merely because
it is helpful, safe and effective in the cure, mitigation,
treatment or prevention of depression, obesity, insomnia,
migraine headaches and chronic fatigue. It should not be a
federal crime for herbalists to truthfully advertise that
5-HTP is the natural safe way to help overcome depression,
obesity, insomnia, etc.
